Safety4 Ltd Terms & Conditions

DESCRIPTION OF THE SERVICE:

Safety4 Limited (the Company) provides the following online applications; www.safety4bodyshops.com, www.myelephantmail.com & www.equiplog.com, (the service) to its registered users (the Customers) under the terms and conditions as detailed below. The Company reserves the right to make changes to its terms and conditions policy as may be required from time to time.

The service provides the customer with the ability to create various documents such as policies, risk assessments, procedures, employee inventories & training records. Customers can also view and download a range of forms & documents designed for use by Motor Vehicle Repair Companies in connection with various requirements placed upon them by Work Providers, Trade Associations, Health & Safety / Environmental Legislation & Employment issues.

The Company is not responsible for any costs that may be incurred while using the service, such as telephone bills or ISP bills, the customer must be accountable for all expenses. The customer also acknowledges that the Company does not provide any technical or customer support for any of the customer’s equipment/software or internet connection, the Company can only assist with problems relating to the safety4bodyshops.com application.

REGISTRATION:

When registering with the Company to use the service, customers are required to provide accurate information about themselves and the company they represent. Where a customer knowingly provides the Company with false information, the Company reserves the right to refuse membership to that customer or terminate the customers online service should it be found at a later date that false information has been supplied.

CUSTOMERS PERMITTED USE OF THE SERVICE:

Registered paid-up users (Customers) may download any or all of the templates, forms and documents as available for download on any of the Safety4 ltd online applications provided they are for their own company’s use. The Customer may save to file, reproduce, edit, modify, print and make back-up copies of any down-loaded document on any computer system provided that it is for use for the customers own company or business.

Where a document has the safety4bodyshops name 0r; any other name owned or associated with Safety4 Ltd, in the document header or footer, this may not be removed as the Company retains all rights to the downloaded document.

CUSTOMERS RESTRICTIONS OF USE OF THE SERVICE:

The Customer shall not sell any part of any of the Safety4 ltd owned online services to third parties or allow any other associate company or persons not employed by the customers company; to use or copy any form or document that has been created and down-loaded from any of the Safety4 ltd owned online services also; the Customer shall not distribute free of charge’ any down-loaded forms or documents to third parties including associate companies or persons not employed by the customers company and; the Customer shall not sell, rent, lease, sub-licence or loan any forms, documents or other parts of the any of the Safety4 ltd owned online services to third parties or any other associate company or persons not employed by the customers company.

Legal action to recover lost revenue may be taken against any customer found to be not complying with the above. 

CUSTOMERS ACCOUNT PASSWORD AND SECURITY:

The customer is responsible for keeping their account user-name and password for any of the Safety4 ltd owned online services confidential and agrees not give their account user name and password to any other person not employed by the customer’s own company.

The customer also agrees to immediately notify the Company of any breach of security known to the customer.

LIMITATION OF LIABILITY:

Whilst the Company takes all reasonable steps to ensure that the information in documents and forms produced and made available is accurate and correct in its content and text, the Company shall not be liable for any inaccuracies, errors or omissions in the content or text of any risk-assessments, procedures, forms or other documents.

The Company, its owners, employees or agents shall not be liable for any loss or damage of any kind including, injuries, ill-health, lost profits other consequential losses arising from the customer’s correct or incorrect use or inability to use the safety4bodyshops.com service. Whilst all reasonable efforts are made to ensure, so far as is reasonably practicable, that all information, risk-assessments, procedures, forms and other documents are free from inaccuracies, errors or deficiencies, the Company does not accept any liability.

It remains the responsibility of the Customer to ensure that any risk-assessment, form or document acquired either through downloading or otherwise, is appropriate and complete in all respects for its intended purpose. The Company gives no warranty that such material will be fit for its intended purpose.

REFUND POLICY:

The registration & annual fee for use of any of the Safety4 ltd owned online services is paid as a lump sum in advance. If you are not satisfied with the service provided and wish to terminate your use and access to the relevant online service, the Company may refund all of the amount or; an amount at our discretion which represents the remaining period of the 12 months paid for. This will depend upon the nature and reasons for your dissatisfaction of the service provided.

Customers requesting a refund should do so by telephone or email (Contact details shown below) or through the 'Contact-us' page on the Safety4Ltd website quoting their user-name and a valid reason for requesting a refund.

The Company promises to respond within 3 working days and to be reasonable and fair when deciding the amount of any refund requested.

PROFESSIONAL ADVICE:

The Customer acknowledges that the documents and forms provided by Safety4 Limited on their web-based application www.safety4bodyshops.com are not intended to replace legal or professional advice on any health, safety or environmental issue. The Customer is responsible for obtaining such advice in all cases where such advice is necessary or appropriate and particularly in any circumstances where the Customer is in any way unsure about the legal aspects of a document or related matters.
